1. Agreement to Terms
By engaging TOWNCITY Movers for moving services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you (“Customer”) and TOWNCITY Movers (“Company”, “we”, “us”).
2. Services Provided
TOWNCITY Movers provides professional moving services including but not limited to:
- Residential and commercial moving
- Packing and unpacking services
- Storage solutions
- Furniture assembly and disassembly
- Specialty item handling
3. Estimates and Pricing
All estimates are based on information provided by the customer. Final charges may vary based on:
- Actual time required to complete the move
- Additional services requested
- Unforeseen circumstances or access difficulties
- Changes to inventory or moving requirements
4. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, certified cheque, and major credit cards. A deposit may be required for certain moves. Late payment charges of 2% per month may apply to overdue accounts.
5. Liability and Insurance
TOWNCITY Movers maintains comprehensive liability insurance. Our liability for loss or damage is limited to:
- $0.60 per pound per article unless additional insurance is purchased
- Full replacement value for items with declared value and additional insurance
- No liability for items packed by customer unless damage is due to our negligence
- No liability for pre-existing damage or normal wear and tear
6. Customer Responsibilities
Customers are responsible for:
- Providing accurate inventory and access information
- Securing parking permits and elevator reservations
- Disconnecting and preparing appliances
- Removing personal and valuable items
- Being present during pickup and delivery
- Providing clear access to both locations
7. Prohibited Items
We cannot transport hazardous materials including:
- Flammable liquids, gases, or explosives
- Corrosive or toxic substances
- Perishable food items
- Plants and live animals
- Personal documents and irreplaceable items
- Cash, jewelry, and other valuables
8. Cancellation Policy
Cancellations must be made at least 48 hours before scheduled move time. Cancellations with less than 48 hours notice may be subject to a cancellation fee. Weather-related cancellations will be rescheduled without penalty.
9. Claims and Disputes
All claims for loss or damage must be reported within 7 days of delivery. Claims must be submitted in writing with supporting documentation. Disputes will be resolved through binding arbitration in Ontario, Canada.
10. Force Majeure
TOWNCITY Movers is not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to weather conditions, traffic, mechanical breakdowns, or government restrictions.
11. Governing Law
These terms are governed by the laws of Ontario, Canada. Any legal proceedings must be conducted in the courts of Ontario.
